PICKSTOCK FOODS LTD STANDARD TERMS & CONDITIONS FOR SALE OF GOODS
Definitions
In this document the following words shall have the following meanings:
1. BUYER means the organisation or person who buys goods
2. GOODS means the product or service supplied by the buyer
3. SELLER means Pickstock Foods Ltd, 2 Coal Lane, Hartshorne, Swadlincote, Derbyshire, DE11 7FN
General
1. These Terms and Conditions shall apply to sales of goods by the seller to the buyer
2. Any variation of Terms and Conditions (including any special terms and conditions agreed between
the buyer and the seller must be agreed in writing).
Price and payment
1. The price shall be agreed verbally when buyer is placing order by telephone, email or text message.
2. Credit terms may be offered subject to satisfactory credit vetting of the buyer by the seller. The offer of credit will be at the sole discretion of the seller.
3. Where credit is offered payment of the price and any applicable costs shall be due within agreed credit terms, unless otherwise agreed in writing. In cases where credit is not offered, payment will be required before release of goods by the seller.
Delivery
1. Unless otherwise agreed in writing, delivery of the goods shall take place at the address specified by the buyer, on the date agreed between the buyer and the seller. The buyer shall make arrangements necessary to take delivery of the goods when they are tendered for delivery.
2. Any damages, shortages, over deliveries should be reported to the seller within 24 hours of receipt of the goods to enable replacement or refund.
Risk
Risk of the goods shall pass to the buyer upon delivery of the goods. Where the buyer chooses to collect the goods themselves, risk will pass when the goods are entrusted or loaded onto their vehicle, whichever happens first.
Return of goods
1. All goods are sold on a firm sale basis i.e the buyer cannot return any unsold goods, to the seller.
2. Any returns must be authorised by a representative of the seller before a credit will be given.
Retention of Title
Title shall not pass to the Buyer until such time payment has been received in full for the goods sold and delivered. Until such time title remains with the Seller.
